These Terms of Service ("Terms") govern your access to and use of AutoLabler for Gmail™ (the "Service"), a Google Workspace Add-on. By installing or using the Service, you agree to be bound by these Terms.
1. The Service
AutoLabler provides automated and user-initiated email labeling functionality within Gmail. The Service operates natively inside Google Workspace and processes email data only to provide labeling suggestions and actions authorized by you.
2. Eligibility and Account Responsibility
You must have a valid Google account and be authorized to grant the required permissions. You are responsible for maintaining the security of your Google account and for all actions taken through the Service.
3. Permissions and User Control
The Service requests only the minimum Google OAuth permissions required to function. You may revoke access at any time through your Google Account settings. Uninstalling the Add-on immediately terminates the Service’s access to your data.
4. Automated Actions
Certain features may automatically apply labels or perform other organizational actions based on your configuration. You explicitly authorize such actions when enabling them.
You acknowledge that automated labeling may occasionally produce incorrect or undesired results. You remain responsible for reviewing and managing your Gmail content and labels.
5. Data Protection and Privacy
Your use of the Service is subject to our Privacy Policy, which forms an integral part of these Terms.
For the purposes of applicable data protection laws:
- You are the Data Controller of your email content.
- AutoLabler acts as a Data Processor, processing data solely on your instructions.
6. Acceptable Use
You agree not to misuse the Service or use it in violation of applicable law, Google Workspace policies, or these Terms. You must not attempt to reverse engineer, interfere with, or disrupt the Service.
7. Intellectual Property
The Service, including its source code, design, branding, and documentation, is the intellectual property of AutoLabler. No rights are granted to you except as expressly stated in these Terms.
You retain all rights to your email content.
8. Service Availability and Changes
The Service is provided on an “as-is” and “as-available” basis. We may modify, suspend, or discontinue features at any time, including to comply with legal or Google policy requirements.
9. Termination
You may stop using the Service at any time by uninstalling the Add-on.
We may suspend or terminate access if you materially breach these Terms, misuse the Service, or if required by law or Google policy.
10. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including warranties of accuracy, reliability, or fitness for a particular purpose.
11. Limitation of Liability
To the maximum extent permitted by law, AutoLabler shall not be liable for any indirect, incidental, consequential, or special damages, including loss of data, loss of emails, mislabeling, or business interruption.
AutoLabler’s total liability for any claim arising out of or relating to the Service shall not exceed the greater of:
- the total amounts paid by you for the Service in the 12 months preceding the claim; or
- one hundred euros (€100).
12. Indemnification
You agree to indemnify and hold harmless AutoLabler from any claims, damages, losses, or expenses arising from your misuse of the Service or violation of these Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Belgium, without regard to conflict of law principles. The courts of Brussels shall have exclusive jurisdiction, unless mandatory consumer protection law provides otherwise.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Service constitutes acceptance of the revised Terms.
